• 「音楽教室の生徒演奏、著作権料は不要」最高裁JASRAC側の上告棄却

  音楽教室でのレッスン演奏に関し、日本音楽著作権協会（JASRAC）が著作権使用料を徴収できるかどうかを巡って争われた訴訟の上告審判決で最高裁は24日、JASRAC側の上告を棄却しました。
  これによりレッスン中の教師の演奏には「演奏権」が及ぶが、生徒の演奏には「演奏権」が及ばないとした知財高裁判決（2021年3月）が確定。生徒の演奏は「著作権使用料」徴収の対象外となります。
  この裁判は、楽曲の著作権を管理するJASRACが音楽教室からも楽曲の使用料を徴収する方針を示したことに対し、ヤマハ音楽振興会などおよそ250の音楽教室の運営会社などが、「支払う義務がない」と主張して訴えを起こしたもの。音楽教室での著作権について最高裁が判断を示すのは初めての事例です。
